The Challenge The 21st century has introduced a number of major changes to the maritime industry in terms of operational and commercial risk management. On the operational front, the ISPS code has been the result of the 9/11 terrorist attack. In essence, ISPS takes the approach that ensuring the security of ships and port facilities is a risk management activity. This means that an assessment of the risks must be made in each particular case. Commercially the Sarbanes-Oxley Law (U.S.A.), which is largely a result of the Enron energy company scandal, has had broad international impact. This law regulates public companies, and as many cargo owners (energy and other commodities) are public, the challenge for the shipping companies is to avoid being seen as a potential liability. Another key example is from the tanker segment where the Oil Companies International Marine Forum (OCIMF) and the gas companies’ forum SITCO, through its best practice guide called Tanker Management and Self Assessment (TMSA).
 It has challenged tanker owners and operators to evaluate their approach to the ISM Code, to improve their management systems and to demonstrate a strong commitment to safety and environmental excellence. To meet OCIMF requirements, you will need to demonstrate that the KPI’s of TMSA to a certain degree are met, and that operators monitor and continuously improve the performance within 12 operational areas (TMSA elements). Owners will need to adopt appropriate internal procedures and systems that will be subject to a self-audit process, For those who have relied on ISM certification as a demonstration of their commitment to safety management, you need to be aware that TMSA requires considerably more.
